1. Definitions
Company", "we", "us", "our" means Dev Marketing trading as Top 10 Mobiles, Unit 10/11, Jeevan Jyoti Bldg, Tarun Bharat Society, Andheri (E), Mumbai 400099,Maharashtra, India.
"Platform" means the mobile applications (Android & iOS) and www.top10retails.in website owned/operated by the Company.
"User", "you", "your" means any natural or legal person who accesses or uses the Platform.
"Order" means a purchase request for Products placed through the Platform.
"Products" means mobile phones, laptops, accessories or any goods offered for sale.
"Serviceable PIN Codes" means the postal codes where our stores currently operate and deliveries/pick‑ups are available.
2. Acceptance of the Terms
By (a) installing, accessing or using the Platform, (b) creating an account, or (c) clicking "I Agree" (or similar) you acknowledge that you have read, understood and agree to be bound by these Terms, the Privacy Policy, the Shipping & Delivery Policy and any other policies referenced herein (collectively, "Agreements"). If you do not agree, do not use the Platform.
These Terms are published in compliance with—
Information Technology Act 2000 & the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules 2021;
Consumer Protection Act 2019 & Consumer Protection (E‑commerce) Rules 2020;
Indian Contract Act 1872;
Sale of Goods Act 1930; and
Other applicable laws of India.
3. Eligibility
Use of the Platform is open to persons who can enter into legally binding contracts under the Indian Contract Act 1872. Minors may use the Platform only with the consent and supervision of a parent/guardian who will be deemed the contracting party.
4. Account Registration & Security
1. To place an Order you must create an account with a valid Indian mobile number or e‐mail address and verify it via one‐time password (OTP) or password.
2. You are responsible for maintaining the confidentiality of login credentials and restricting access to your device. All activities that occur under your account will be deemed authorized by you.
3. You agree to provide accurate, current and complete information and to update it promptly.
5. Products, Pricing & Taxes
1. All Product descriptions, images, prices and availability are subject to change at any time without notice.
2. Prices are inclusive of all applicable Goods & Services Tax (GST) unless stated otherwise.
3. Despite our best efforts, products may be mispriced. We reserve the right to cancel any Order containing pricing errors.
6. Orders & Payments
1. Orders are confirmed only after successful pre‑payment using Juspay‑enabled payment instruments (UPI, credit/debit cards, net‑banking, EMI schemes, etc.).
2. Upon placing an Order you will receive an e‑mail/SMS/WhatsApp confirmation with an Order ID. This constitutes acceptance of your Order by the Company.
3. No cash‑on‑delivery or post‑paid options are available.
7. Delivery, In‑Store Pick‑Up & Title Transfer
1. Same‑Day Delivery – usually within four (4) hours of Order confirmation, subject to stock and logistics.
2. Next‑Day Delivery – where same‑day delivery is not feasible or Orders are placed near store closing hours.
3. In‑Store Pick‑Up – free at any participating store within the Serviceable PIN Codes.
4. Risk and title in the Product pass to you upon physical delivery/pick‑up and signing of delivery acknowledgement/open‑box checklist.
5. Delivery delays caused by force‑majeure events (rain, strikes, transport disruptions, pandemics) are excluded from guaranteed timelines.
8. Replacement & No‑Refund Policy
1. No monetary refunds are provided for prepaid Orders
2. A one‑time replacement request may be raised within 72 hours of delivery for (a) defective/damaged Product, or (b) incorrect Product delivered.
3. Eligibility conditions:
Product must be unused, unopened, sealed in original manufacturer packaging with all accessories & IMEI/serial no. intact
For open‑box delivery, any issues must be reported to the delivery partner immediately; the item can be returned on the spot.
4. After inspection and approval, a replacement of the same model (or store credit if unavailable) will be dispatched within 2 business days.
5. Products damaged due to misuse, electrical surges, liquid ingress or unauthorised repairs are excluded from replacement.
9. Warranty & After‑Sales Support
Manufacturer warranty terms apply to all Products. The Company facilitates but does not itself provide warranty service. For warranty claims, contact the authorised service centre listed on the warranty card.
10. User Conduct & Acceptable Use
You agree not to:
Breach or attempt to breach Platform security.
Engage in fraud, payment misuse or chargebacks.
Upload viruses, malware or harmful code.
Use automated systems (bots, crawlers) to access the Platform without written consent.
Infringe any intellectual‑property rights.
Post obscene, defamatory, harassing or otherwise unlawful content.
Under IT Rules 2021, Rule 3(1)(b) we reserve the right to remove any content or suspend/terminate accounts that violate these rules without prior notice.
11. Intellectual Property
All trademarks, logos, service marks, Product images, UI/UX layouts, code and content on the Platform are the property of the Company or its licensors and protected under the Trade Marks Act 1999 and Copyright Act 1957. No licence is granted except as expressly stated.
12. Third‑Party Services & Links
The Platform integrates third‑party services (OneSignal, Google Maps API, WhatsApp API, Juspay, etc.). We do not control and are not responsible for their content or privacy practices. Your use of such services is subject to their respective terms.
13. Limitation of Liability
To the maximum extent permitted by law:
1. The Company's aggregate liability for any claim shall not exceed the amount paid by you for the Product giving rise to the claim.
2. The Company is not liable for indirect, incidental, punitive or consequential damages, loss of data, loss of profits, or business interruption.
14. Indemnity
You agree to indemnify, defend and hold harmless the Company, its directors, employees, affiliates and agents from any claims, damages, liabilities, costs and expenses (including legal fees) arising from your use of the Platform, breach of the Agreements, or violation of any law or rights of a third party.
15. Suspension & Termination
We may suspend or terminate your account and access to the Platform (a) for breach of these Terms; (b) upon request bylaw‑enforcement; (c) for extended inactivity; or (d) for any operational or security reasons.
16. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict‑of‑laws principles. Subject to the arbitration clause below, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction.
17. Dispute Resolution & Arbitration
1. Any dispute shall first be attempted to be resolved amicably within 30 days of a written notice.
2. Failing resolution, the dispute shall be referred to arbitration in accordance with the Arbitration & Conciliation Act 1996.
3. The tribunal shall comprise a sole arbitrator jointly appointed; failing agreement, the High Court of Bombay may appoint.
4. Seat/venue of arbitration: Mumbai.
5. The award shall be final and binding.
18. Modifications to Terms
We may revise these Terms at any time by posting an updated version on the Platform and updating the "Last updated" date. Changes will be effective upon posting. Continued use constitutes acceptance of the revised Terms.
